What are my rights ? – My resident Permit has expired and my employer has suspended the job contract

France has started gradually moving all the resident permit applications and renewals to an online system. So, this process has created a lot of delays in processing of the applications. Some people have been waiting for more than 6 months without answers.

If you fall into this situation, you might benefit from a grace period, depending on your type of resident permit.

During th​is grace period of 3 months​, you will retain all of ​your social rights as well as ​the right to ​work.

Your employer cannot suspend your work contract​ during these 3 months.

Under Article 20 of Order No. 2020-1733 of 16th December 2020, the ​following provisions came into force on 1st May 2021.

You can benefit from a grace period of up to 3 months after the expiry date and prove the regularity of your stay in France, If you are holding one of the following resident permits,

  • 4 years ​Carte de Séjour
  • 10 years Carte de Résident
  • a residence permit for more than one year provided by an international regulation that requires a renewal.

​In some departments​ (check with your local prefecture), ​the 3-month grace period is​ also provided to people who have submitted​ their renewal applications before their expiry date. It concerns the following resident permits only,

  • Temporary ​Carte de Séjour
  • ​Multi-year ​Carte de Séjour other than the one having a​ validity of ​4 years

    Is this grace period in effect by default or is it with the prolongation certificate?

    In my case, I have applied for renewal of my talent – recherche (3 months before expiry), now I have my card expired, but I haven’t received any update, and neither the prolongation certificate, nor the recipisse.

    So should I assume the grace period applied to my case, thus I have the right to continue my job?
