The Schengen Borders Code allows EU Member States to temporarily reintroduce border control at internal borders in response to serious threats to public policy or internal security. These include actions to control irregular migration, migrant smuggling activities, organized crime, asylum reception system, etc. These measures must be used as a last resort, in exceptional circumstances, and must be proportional to the threat.
The duration of such controls is limited and should be as short as necessary. While the European Commission can share opinions on these measures, it cannot overrule a Member State’s decision to implement them.
